General
  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
Who can enter
  1. Entry is only open to Australian residents aged 18 or over. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin (“Eligible Entrant”).
  2. The Promoter is HEMPEL (WATTYL) AUSTRALIA PTY LTD (ABN 40 000 035 914) (the “Promoter”). The Promoter’s address is Level 3, 2 Burbank Place, Norwest NSW 2153.
How to enter
  1. To enter, Eligible entrants must, during the Promotional Period (defined below), purchase a minimum of $50 (incl GST) of Monarch branded accessories (“Participating Product”) at a Wattyl Paint Centre in Australia (“Participating Store”).
  2. To enter, Eligible Entrants must:
    1. Purchase any Participating Product from a Participating Store; and
    2. Go to the website listed (win.wattyl.com.au), and enter / register their details; and
    3. Upload a photo of their purchase receipt. Receipt must clearly show date, store and total.
  3. Subject to these terms and conditions, entrants may enter as many times as they like during the Promotion Period, but each purchase receipt is only eligible to enter once, regardless of the spend on Monarch products on the receipt.
Number of Entries permitted
  1. Subject to these terms and conditions, entrants may enter as many times as they like during the Promotion Period, but each purchase receipt is only eligible to enter once, which then will equate to the number of entries as per Clause 7.
Open, Close, Draw and Publish dates
  1. Promotion commences at for any purchase made from 22/01/2024. Online entry commences at 5.00am AEDT on 22/01/2024. Final purchases must be made on 01/03/2024. Final entries must be received online by 11.59pm AEDT on 01/03/2024 (“Promotional Period”).
  2. All website entries are deemed to be received at the time of receipt into the Promoter's database NOT the time of transmission by the entrant.
  3. There will be one (1) draw at the end of the promotion. The winners will be drawn on 07/03/2024 at 11am AEDT at the Promoter’s Office. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. All entries will be divided into the following State groups QLD, NSW/ACT, VIC/TAS, NT/SA and WA. The first entries drawn as per the table below from each State group will be deemed a Winner. Winners will be notified by phone and their names published at win.wattyl.com.au from 14/03/2024. Winners may be displayed on Wattyl’s Facebook and Instagram pages/stories.

  1. The Promoter may, in its absolute discretion, select a replacement winner from the valid entries in the event that an invalid entry or ineligible entrant is drawn.
Prize
  1. Each Winner drawn will each a Euromaid 121L Bar Fridge with Monarch branding (Model No. EBF126W) RRP $350 incl GST. There are 13 prizes to be won throughout Australia. Total Prize Pool for Australia is $45500 incl GST. State Based Prize Pools are in the stable above.
  2. The Winner will be able to collect their prize from the store of entry within 3 weeks of the draw. It is the Winner’s responsibility to organise any transport to and/or from the Participating Store. The winner is responsible for collecting the prize and any expenses he or she incurs while doing so.
  3. Entrants may be asked to provide their purchase receipt to claim a prize.
  4. There is a limit of one prize per person, business account, email address or household, excluding SA residents.
  5. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize. Each prize must be taken as stated. The Winner is responsible for any fees associated with owning and maintaining the prize. Prize is non-transferable, cannot be exchanged for any other prize, and cannot be exchanged for cash. The prize comes with a standard warranty.
  6. The warranty on the goods and services obtained as a result of this promotion remains the sole responsibility of the manufacturer/supplier of the prize. The Promoter will not be responsible for any malfunction, fault, technical or design error or any other breakdown concerning the Prize whatsoever. The Winner undertakes to liaise directly with the providers of the Prize in respect of any manufacturer’s warranties and/or guarantees and hereby release the Promoter from any liability whatsoever in respect thereto. For clarity, the Winner waives all of its rights to make any claim against the Promoter in relation to any aspect of the Prize and Warranty whatsoever.
  7. A draw for any unclaimed prizes will take place on 27/06/2024 the same time and place as the original draw, subject to any directions from a regulatory authority. Winners (if any are required) will be notified in telephone (within 2 business days of the draw) and their names will be published on 27/06/2024 at win.wattyl.com.au.
Further Terms and Conditions
  1. Entrants may only enter in their own name. Inaudible, incomprehensible, illegible, and incomplete entries may be deemed invalid. Only those entries received by the Promoter will be included in the competition draw.
  2. Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request. The Promoter reserves the right to disqualify any entrant who provides false information or who seeks to gain an unfair advantage or to manipulate this competition.
  3. The Promoter reserves the right, in its sole discretion, to reject any entries which do not comply with these Terms and Conditions and will not provide any reasons for rejection. Entries that do not comply with these Terms and Conditions of entry will be deemed invalid and are not eligible to win a prize.
  4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  5. Any entrant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
  6. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.
  7. The Promoter reserves the right to request winners to sign a winner's deed of release (and indemnification) or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
  8. The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
  9. The Promoter's decision in relation to any aspect of the competition is subject to State and Territory legislation but also final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner's nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.
  10. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received.
  11. In participating in the prizes, the winner/s agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
  12. Prize-winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
  13. The Promoter (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generated entries and the use "scripting" is not permitted and will not be accepted.
  14. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.
  15. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').
  16. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize The Promoter (including its' officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
  17. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://wattyl.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter complies with the privacy principles set out in the New Zealand Privacy Act 1993. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia and New Zealand.
