General
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
Who Can Claim
Offer is only open to Australian residents aged 18 years or over who have an existing Wattyl Trade Account Holder (COD or 30 Days) excluding PRJ account holders (“Eligible Participants”).
Employees (and their immediate families) of the Promoter, participating stockists and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse,
ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother,
step-sister or 1st cousin.
The Promoter is HEMPEL (WATTYL) AUSTRALIA PTY LTD (ABN 40 000 035 914) (the “Promoter”). The Promoter’s address is Level 3, 2 Burbank Place, Norwest NSW 2153.
How to Claim
To claim, Eligible Participants must:
Between 01/04/25 and 30/04/25 (“Purchase Period”)
Purchase a minimum of $1000 (incl GST after all discounts) of any Wattyl Ultra branded paint products in any size (“Participating Product”) in one transaction and retain a copy of their receipt or tax invoice
At a Wattyl Paint Centre in Australia (“Participating Store”)
On their existing Wattyl Trade Account (COD or 30 Day)
Head to win.wattyl.com.au and upload a photo of their Tax Invoice with their details.
All claims must be received by 09/05/25.
Gift, Number of Claims Permitted and Distribution of Gift
The Claimant will receive a $50 Shell e-gift Card (“Gift”) when $1000 spent in a single transaction (as per clause 6). This is capped at $150 (3 x Gifts) when $3000 is reached.
Anything spent above $3000 on that Tax Invoice will not receive additional gift/s. There is a limit of 3 (three) gifts per Tax Invoice
Subject to these terms and conditions there is no limit on the total number of Tax Invoices Eligible Participants submit, but each Tax Invoice is only eligible to claim once (capped at 3 (three) claims as per Clause 7).
The Claimant will receive the Gift/s to the supplied email address by 30th May 2025. Each Claim will be provided as a separate email and e-gift card.
It is the Claimant's responsibility to ensure that the correct email address is entered into the Claim Form (as per Clause 6)
It is the Claimant’s responsibility to add their e-gift card to their digital wallet for use.
If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. Cash will not necessarily be awarded as a substitute. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the Gift. Each prize must be taken as stated. The Winner is responsible for any fees associated with using the Gift. Gift is non-transferable, cannot be exchanged for any other Gift, and cannot be exchanged for cash.
Further Terms and Conditions
Claimants may only enter in their own Business Name. Inaudible, incomprehensible, illegible, and incomplete claims may be deemed invalid.
In the event of more than one owner being a potential Eligible Participant (i.e. where one business has more than one owner), a single Eligible Participant email address must be nominated at the time of claim.
It is expected this address is the business’ email address so the Gift can be awarded to the owner.
In the event of a dispute as to the identity of the claimant, the Promoter will make a determination and no correspondence will be entered into.
Claimants must retain their original or a copy of their purchase receipt(s) for all Claims as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s claims and forfeiture of any right to a Gift.
Any Claimant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an Claimant is awarded a prize and then found to have breached this clause, the Claimant must immediately return any prize awarded. The Promoter has sole discretion to determine if this clause has been breached by any Claimant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the Claimant has breached this clause. An Claimant must provide any requested documentation to the Promoter upon request. The Promoter reserves the right to disqualify any Claimant who provides false information or who seeks to gain an unfair advantage or to manipulate this competition.
The Promoter reserves the right, in its sole discretion, to reject any claims which do not comply with these Terms and Conditions and will not provide any reasons for rejection. Claims that do not comply with these Terms and Conditions of entry will be deemed invalid and are not eligible to receive a Gift.
The Promoter reserves the right, at any time, to verify the validity of claims and Claimants (including an Claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. If there is a dispute as to the identity of a Claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Claimant.
Any Claimant found to be entering incorrect contact details, including incorrect email contact details, will have all entries invalidated and any claim to any prize will be invalidated. If such a Claimant is awarded a prize and then found to have breached this clause, the Claimant must immediately return any Gift awarded. The Promoter has sole discretion to determine if this clause has been breached by any Claimant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the Claimant has breached this clause. A Claimant must provide any requested documentation to the Promoter upon request.
The Promoter reserves the right to request Claimants to sign a winner's deed of release (and indemnification) or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated Gift delivery address and/or proof of entry validity (including phone bill) in order to claim a Gift. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the Gift in whole and no substitute will be offered.
The Promoter's decision in relation to any aspect of the competition is subject to State and Territory legislation but also final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Gifts are subject to availability, not transferable or exchangeable and, cannot be taken as cash. Gifts will be sent to the winner's nominated email address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for Gifts damaged, lost in transit, or an incorrect email address was submitted.
All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received.
In participating in the Activity, the claimant/s agree to participate and co-operate as required in all editorial activities relating to the Activity, including but not limited to being interviewed and photographed. The Claimants (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
Claimants are advised that tax implications may arise from their Gifts and they should seek independent financial advice prior to acceptance of that prize.
The Promoter (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generated entries and the use "scripting" is not permitted and will not be accepted.
Any cost associated with accessing the promotional website is the Claimant's responsibility and is dependent on the Internet service provider used.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Claimant; or (f) use of a prize The Promoter (including its' officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable guarantees. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://wattyl.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Claimant. The Privacy Policy also contains information about how Claimants may opt out, access, update or correct their PI, how Claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter complies with the privacy principles set out in the New Zealand Privacy Act 1993. All entries become the property of the Promoter. The Promoter will not disclose Claimant’s personal information to any entity outside of Australia and New Zealand.
